Terms and Conditions
These general terms and conditions for Users (hereinafter "Terms and Conditions") establish the conditions and terms applicable to all users of ABR Group ApS (hereinafter "Company"). Exceptions to these Terms and Conditions may be established in individual agreements, which will always take precedence over these Terms and Conditions.
These Terms and Conditions are effective from 1st. January 2022.
1.Provider of the Service

2.Service
ABR Group ApS is a courier service company that transports goods within Denmark. We offer the transportation of goods using the following vehicles:

Customers are responsible for ensuring that the goods can be transported in the chosen vehicle. If the goods are too large for the selected vehicle, the driver has the right to refuse transport. In such cases, the customer will be charged the minimum rate for the transport. Before being authorized to transport goods, drivers must go through ABR Group's approval process. Once approved, drivers are granted the rights and obligations outlined in these terms and conditions. The service allows customers to request a transport, which is then accepted by one of our drivers. Once a driver accepts the transport request, information such as the names of the customer and driver, the type of vehicle, real-time location, addresses, and instructions are exchanged.
3.Transport of Goods
ABR Group ApS allows customers to request the transportation of goods by our drivers. Customers can either request an immediate transport or schedule a transport for a specific date and time. ABR Group ApS reserves up to one hour flexibility for pick-up time adjustments and will confirm the arrangement with the customer.
Customers are fully responsible for providing the correct weight of the goods at the time of booking. The weight of the goods determines how ABR Group ApS processes the order.
ABR Group ApS enters into a contract with the customer and then assigns a driver to the transport request.
Customers can choose to have the goods left outside the specified address. In such cases, customers must clearly indicate this when booking. Once the goods are placed as indicated by the customer, the delivery is considered complete, and the driver will notify the customer via email or SMS. After this, the risk for the goods is transferred to the customer, and the goods are no longer covered by ABR Group ApS's liability and insurance as per section 11 of these terms and conditions.
4.Delivery
When the goods are considered delivered to the correct recipient, the customer will be notified via email or SMS.
The customer is responsible for ensuring that they, or an authorized recipient of the goods, are present at the specified delivery address at the time the driver arrives. This does not apply if the customer has given consent for the goods to be left outside, as mentioned in the previous section.
If an authorized recipient is not present at the specified delivery address, the driver will attempt to contact the customer to arrange an alternative delivery. The customer will be responsible for any additional costs associated with an alternative delivery. This does not apply if the customer has given consent for the goods to be left outside, as mentioned earlier.
If the driver is unable to contact the customer, the driver is entitled to leave the goods outside the address after a waiting period of ten minutes. The customer will be responsible for the waiting time. After this, the risk for the goods is transferred to the customer, and the goods are no longer covered by ABR Group ApS's insurance as per section 11 of these terms and conditions.
5.Goods Not Permitted for Transport
Customers must not use ABR Group ApS's transport services for the following types of goods:

Illegal or hazardous items, such as explosives, dangerous chemicals, fireworks, narcotics, weapons, ammunition.

Gas and/or compressed air, butane, methane, propane, and other liquid gases, or petrochemicals.

Items intended for or obtained in connection with illegal activities.

We strictly transport goods and not people.
If a customer uses ABR Group ApS to transport any of the above items, these items will not be covered by ABR Group ApS's insurance as outlined in section 11, and the customer will be immediately excluded from using ABR Group ApS's services.
6.Rating and Exclusion of Drivers
ABR Group ApS uses a rating system where drivers are rated by customers on a scale of 1 to 5 stars, representing the overall performance of the driver as follows:

When evaluating a driver's overall performance, customers can consider factors such as:

Punctuality

Other relevant factors
Customers are encouraged to use ABR Group ApS's rating system after the completion of each transport service before they can use the service again.
Drivers who do not maintain a continuous average rating of 4.5 or higher will be reviewed by ABR Group ApS. Based on this review, ABR Group ApS will decide whether to continue the cooperation with the driver. Drivers will be excluded from ABR Group ApS's services if ABR Group ApS decides to terminate the cooperation.
7.Rating of Customers and Exclusion
ABR Group ApS reserves the right to implement a rating system where drivers can evaluate customers.
If such a system is established and a customer does not maintain a satisfactory rating, ABR Group ApS is entitled to exclude the customer from using ABR Group ApS's services without prior notice.
A customer who is excluded from using ABR Group ApS's services will be notified promptly via email to the customer’s registered email address.
8.Price and Fees for Transport Services Ordered via ABR Group ApS
Using the ABR Group ApS website is free.
The current rates for transport services are as follows:

The minimum charge for up to 30 minutes and 10 kilometers is 176 kr.

For durations over 30 minutes, the rate is 320 kr per hour.

For distances over 10 kilometers, the rate is 11 kr per kilometer.
Before placing an order, the customer can see the price after entering the pickup and delivery addresses, so they can see the price before they place the order. All our prices include VAT.
ABR Group ApS reserves the right to change or update these rates at any time, and it is the customer’s responsibility to stay informed about the current rates for transport services ordered via ABR Group ApS.
ABR Group ApS also reserves the right to introduce adjusted billing rates during promotional campaigns.
Upon placing an order, an estimated price will be provided to the customer. The final amount will be invoiced once the transport is completed. If the final amount for the transport exceeds the estimated price, the customer will be billed for the difference. If the final amount is less than the estimated price, the invoice will reflect the lower amount.
If payment cannot be processed and the transport has been carried out, the customer will subsequently be billed for the transport. ABR Group ApS reserves the right to hand over the case to a collection agency if the customer does not pay on time.
If the customer wishes to cancel a transport, they must do so at least two hours before the scheduled pickup time. If the transport is not canceled within this timeframe, the customer will be charged a fee equivalent to the minimum fare for the transport.
If the driver has arrived at the pickup location, the customer must pay the minimum fare for the transport.
If an authorized recipient is not present at the delivery location, the customer is responsible for any additional costs incurred. These costs depend on the extra time the driver spends until the delivery is completed.
9.Payment
Payments made are non-refundable.
Any complaint regarding a completed transport or its billing must be submitted via email to aya@abrgroup.com within 24 hours after the transport is completed.
The customer agrees to pay for the completed transport service, and ABR Group ApS has the right to invoice the customer for the service, including any cancellation fees, extra waiting/loading time, and other related costs.
ABR Group ApS uses a payment service provider to facilitate transactions.
The processing of payments related to the customer’s use of ABR Group ApS will be subject to the terms, conditions, and privacy policies of the payment service provider. ABR Group ApS is not responsible for any errors on the part of the payment service provider. In connection with the use of ABR Group ApS, ABR Group ApS will receive certain transaction information, which will be used solely in accordance with the privacy policy outlined in these terms.
10.Responsibility, Insurance, and Compensation
As a customer of ABR Group ApS, your goods are insured from the moment the driver indicates possession of the goods until delivery is complete. See sections 4.5 and 5.4 of ABR Group ApS’s terms and conditions.
This does not apply to electronics, cash, securities, documents of any kind, jewelry, gems, and watches, which are excluded from insurance coverage and liability by ABR Group ApS.
Insurance coverage requires that the customer's goods are properly packed or packaged to withstand the normal course of transport. Proper packing or packaging is the customer's responsibility. Furthermore, insurance coverage requires that the customer has specified the correct weight of the goods when booking the transport.
ABR Group ApS’s liability is limited to the insurance coverage, and no claims can be made against ABR Group ApS for losses or circumstances not covered by the insurance, as stated below.
Insurance coverage depends on the value of the customer’s goods. Customer’s goods are insured with a maximum coverage of 5,000 kr per transport with a deductible of 500 kr.
The insurance covers the individual item with its replacement value, i.e., the value immediately before the insurance event with reasonable deduction for age, use, market conditions, reduced usability, or other circumstances. Documentation of the item's value is required.
In the event of damage to or theft of the customer’s goods, the customer must report it to ABR Group ApS immediately and no later than 6 hours after the goods are reported delivered or missing due to theft. The damage must be reported in writing to aya@abrgroup.com.
The deductible, as stated in section 11.5, will be deducted from the amount paid to the customer in the event of a covered damage during transport.
The insurance does not cover losses exceeding the maximum coverage specified above, regardless of the higher value of the item. Any form of indirect loss is entirely excluded from coverage as stated in sections 11.11 and 11.12.
The insurance does not cover loss or damage resulting from the customer's own negligence. Negligence includes, for example, lack of proper packaging of the goods as stated in section 11.3.
Losses resulting from delays by the driver are not covered by the insurance, and ABR Group ApS is not liable for losses the customer suffers as a result of a delay.
The customer cannot claim compensation for indirect damages, including consequential damages, resulting from the driver's transport service.
The insurance does not cover damage to goods listed in section 6 of these terms and conditions.
For sales and purchase shipments, the invoice amount, including shipping costs, constitutes the maximum compensation.
11.Driver Engagement
Customers are prohibited from engaging ABR Group ApS drivers who have performed transport services for the customer outside of ABR Group ApS and its platform while there is an existing agreement between the customer and ABR Group ApS, and for a period of three (3) months after the customer’s last use of ABR Group ApS’s services. This also applies if the customer or the driver terminates the collaboration or is excluded.
If the customer engages or attempts to engage ABR Group ApS’s drivers outside of ABR Group ApS and these terms or a separate agreement, ABR Group ApS is entitled to compensation amounting to 100,000 kr per driver unless general principles of liability lead to higher compensation.
12.Breach of Contract
If the customer fails to comply with the obligations under these terms or a separate agreement, ABR Group ApS is entitled to terminate the agreement.
A breach justifying ABR Group ApS’s termination of the agreement includes, but is not limited to:

The customer’s employees exhibit aggressive, harassing, or degrading behavior.

The customer does not comply with applicable laws, including but not limited to the Penal Code, Weapons Act, and the Act on Controlled Substances.

Non-payment.

Violation of section 10.1.
ABR Group ApS is obliged to inform the customer immediately about the breach.
13.Disclaimers
Use of the ABR Group ApS website is at the customer’s own risk.
The information and recommendations the customer receives on the ABR Group ApS website are for general informational purposes only and do not constitute advice.
The customer must indemnify ABR Group ApS for any loss or expenses arising from the customer’s breach of these terms or a separate agreement or violation of applicable law.
ABR Group ApS is not responsible for the following:

Inaccurate content or errors on the ABR Group ApS website, such as typographical errors or unintended functionalities.

Personal injury or property damage that occurs when the goods are not in the possession of ABR Group ApS.
-
The behavior or actions of drivers or other customers beyond what is covered by insurance, as stated in section 9.
14.Changes to the Terms and Conditions
ABR Group ApS may change these terms and conditions or discontinue the service at any time and without prior notice by informing the customer via email to the customer’s associated email address.
In the event of changes to these terms and conditions, the customer will be notified, and any use of the ABR Group ApS website by the customer will be considered acceptance of these terms.
15.Interactions with Third Parties
ABR Group ApS may place hyperlinks to other websites or applications owned by third parties on the ABR Group ApS website, which are beyond ABR Group ApS’s control.
Such services may have their own terms, conditions, and privacy policies that are unrelated to ABR Group ApS.
18.Governing Law and Jurisdiction
These terms and conditions are governed by Danish law.
Any dispute arising from these terms and conditions must be brought before the Aalborg City Court.
